Acceptable Use Policy

1. AI-Generated Content — Your Responsibilities

ViraCreator uses artificial intelligence to generate video content, avatars, scripts, and images. You are solely responsible for all content you create using our Service, including ensuring it complies with applicable law, platform policies, and these terms.

Unintentional Likeness

AI avatar and image generation is probabilistic. ViraCreator does not guarantee that generated avatars, faces, or personas will be free from resemblance to real individuals. You are solely responsible for reviewing all generated content before use. If a generated avatar, face, or character bears a resemblance to a real person — whether intentional or not — you must not publish or distribute that content without obtaining appropriate consent from the person whose likeness is depicted, or regenerating the content to remove the resemblance. ViraCreator accepts no liability for claims arising from unintentional likeness in AI-generated content that you choose to publish.

Advertising Platform Disclosure

When distributing AI-generated content on third-party advertising platforms, you are solely responsible for complying with those platforms' AI content disclosure requirements. This includes but is not limited to:

Meta (Facebook/Instagram): Must select "AI-generated or digitally altered" when uploading ads containing AI-generated imagery or video
Google Ads: Must disclose materially altered or synthetic content in election ads and follow AI content policies for all ads
TikTok: Must label AI-generated content using TikTok's built-in disclosure tools
YouTube: Must disclose realistic altered or synthetic content in video descriptions or during upload

ViraCreator is not responsible for account suspensions, bans, or penalties resulting from your failure to make required disclosures on third-party platforms.

Advertising Claims Accuracy

You are responsible for the accuracy of all claims, testimonials, statistics, and representations in AI-generated advertising content. ViraCreator does not verify product claims. You must ensure your ads comply with:

FTC guidelines on advertising and endorsements (US)
ASA codes (UK)
Any other applicable advertising standards in your jurisdiction

AI-generated scripts and copy may contain inaccuracies. Always review generated content before publishing.

EU AI Act Compliance

If you distribute AI-generated video content to users in the European Union or United Kingdom, you are responsible for complying with applicable synthetic media labeling requirements, including Article 50 of the EU AI Act where applicable. This includes ensuring generated content is marked as AI-generated when required by law.

2. Prohibited Content

You may not use ViraCreator to create, distribute, or facilitate:

Impersonation and Synthetic Media

Content depicting, impersonating, or mimicking any real person — living or deceased — without that person's explicit written consent, regardless of whether the resemblance was intentional
Uploading another person's likeness, voice, or biometric data to generate avatars or content without their consent
Content designed to deceive viewers into believing a real person said or did something they did not
Synthetic media of public figures for commercial endorsement without verified consent
Publishing AI-generated content that you know or reasonably suspect bears a likeness to a real person without first obtaining consent or regenerating the content

Deceptive and Harmful Advertising

Ads containing false or misleading claims about products, services, results, or testimonials
Fake reviews, fabricated social proof, or invented customer testimonials
Scam, fraud, phishing, or get-rich-quick schemes
Content promoting unverified health claims or treatments
Counterfeit goods or trademark infringement

Political and Election Content

Political advertisements or election-related content of any kind
Content designed to influence voting behaviour or political opinion
Content impersonating candidates, political parties, or government bodies

Harmful and Illegal Content

Content that is illegal in the jurisdiction where it will be viewed or distributed
Content targeting, exploiting, or depicting minors
Hate speech, harassment, or content promoting violence or discrimination
Sexually explicit content
Content promoting illegal drugs, weapons, or dangerous activities

3. Third-Party AI Provider Terms

ViraCreator uses third-party AI services to generate content, including Anthropic (Claude), Google, and others. Content generated through our Service is also subject to the acceptable use policies of these underlying providers. We may be required to restrict or remove content that violates our providers' terms, even if it does not otherwise violate this AUP.

4. No Exclusivity Guarantee

AI systems may produce similar or identical outputs for different users. ViraCreator does not guarantee that content generated for you will be unique, exclusive, or not produced for other users. You should not rely on AI-generated content for purposes requiring uniqueness without independent verification.

5. Human Review Requirement

You must review all AI-generated content — including scripts, avatars, and videos — before publication. AI systems can produce inaccurate, unexpected, or inappropriate outputs, including avatars or faces that unintentionally resemble real individuals. You bear full responsibility for any content you publish. ViraCreator is not liable for harm arising from AI-generated content that was published without adequate human review.

6. Enforcement

We reserve the right to:

Remove content that violates this AUP
Suspend or terminate accounts that repeatedly or seriously violate this AUP
Report illegal content to relevant authorities
Cooperate with law enforcement investigations

We may act without prior notice where we believe a violation is serious, ongoing, or harmful.

8. Updates to This Policy

We may update this AUP as our product evolves and as AI regulations develop. We will update the "Last updated" date at the top of this page and notify users of material changes via email or in-app notice.
